A tentative 25 million dollar settlement revealed Wednesday to end almost every sexual misconduct lawsuit brought against Harvey Weinstein and his former film studio's board was praised by a plaintiff and some lawyers but criticized by others who say those who opt out are punished.

According to The New York Times, lawyers involved in the investigation are saying that Weinstein would not have to pay any money out of his own pocket in the settlement, nor would he have to admit to doing anything wrong.

He said it was "outrageous that the proposed settlement will seek to bind non-participating members by providing a release to the insurance companies and the directors of the Weinstein Company itself". A lawyer for The Weinstein Co. declined comment. "While this settlement is flawed, we know it represents the hard work of several survivors of Harvey Weinstein".

"Just because someone makes a claim doesn't make it true", Rotunno said.

More than 30 people have accused Weinstein of sexual misconduct, sexual harassment and rape.

The agreement will be finalised after court approval and a final assent of the parties.

The settlement still needs to be accepted by the courts, but has reportedly gotten "preliminary approval". The payout to the accusers would be part of an overall $47 million settlement meant to close out the company's obligations, according to a half-dozen lawyers, some of whom spoke about the proposed terms on the condition of anonymity.

Beginning in 2017, a flood of sexual misconduct claims against Weinstein helped catalyze the #MeToo movement - with many women filing suits against the movie mogul.

Judges have also increased the producer's bail to US$5 million from US$1 million after he failed to wear the required electronic tracking device.

While the deal, if approved, may settle civil claims, Weinstein is still scheduled to face a criminal trial in NY in January on charges of sexually assaulting two women.

Weinstein has pleaded not guilty to criminal charges that he sexually assaulted two women, one in 2006 and another in 2013.
